SECTION 1. Section 30-146 of the Village of Capac Code of Ordinances is rescinded and replaced with the following:
Sec. 30-146. Membership.
There is hereby established a zoning board of appeals as per Michigan Zoning Enabling Act, Act 110 of 2006, per Article 6, Zoning Board of Appeals. The zoning board of appeals shall consist of three (3) members and two (2) alternate members appointed by village council. One member or alternate member may be a member of the Village Planning Commission. The remaining members and alternate members shall be electors who are not employees or contractors of the village. Each member (3) or alternate member (2) shall be appointed for a term of three (3) years, except that term of office of the Village Planning Commission member shall terminate if his/her membership on the Village Planning Commission terminates before the end of the three-year Zoning Board term. The Zoning Board of Appeals members shall elect a chairman, vice-chairman, and secretary. An alternate member may be called to serve on the Zoning Board of Appeals whenever a regular member abstains due to conflict of interest or whenever a regular member is absent. That alternate member shall continue to serve on a case until a final decision has been made.
SECTION 2. Section 30-402 of the Village of Capac Code of Ordinances is amended to add subsection (5) as follows:
5. Self-storage facility, subject to the following conditions:
a. For purposes of this section, “self-storage facility” means a building or buildings consisting of individual, small self-contained units that are leased to the general public for the storage of personal and household goods.
b. No activity is permitted other than activity directly related to the rental and use of self-storage units.
c. No building or structure shall exceed one story in height.
d. All self-storage units must be accessible by a safe drive which meets all requirements of this Ordinance and is sufficient in size to allow the ingress, egress, access, and passage of emergency vehicles.
e. All storage must occur within enclosed buildings. No external or outside storage is permitted, including, by way of example and not limitation, storage of boats or recreational vehicles.
b. All areas where self-storage units are located shall be enclosed by a fence that provides adequate security for the self-storage units and is consistent with the fencing requirements detailed in Section 30-12 of this Ordinance.
c. If the parcel where the self-storage facility is located adjoins property which is zoned for any type of residential use, landscaping is required which satisfies all conditions in Section 30-11 of the Village of Capac Zoning Ordinance
d. Security lighting that satisfies all lighting requirements detailed in Section 30-426(C)(6) must be installed and operational at a self-storage facility. The purpose of this requirement is to provide security lighting for the security of the facility, its patrons and the general public.
SECTION 3. No Other Amendment.
Except as amended above, this Ordinance does not amend any other provision of the Village of Capac Ordinances.
SECTION 4. Severability
The provisions of this Ordinance are hereby declared to be severable. If any clause, sentence, paragraph, rule, regulation, section or subsection is declared void or inoperable for any reason by any court, it shall not affect any other part or portion thereof other than the part declared void or inoperable.
SECTION 5. Effective Date and Publication of Notice
This Ordinance shall take effect 15 days after publication.
