AN ORDINANCE TO AMEND CHAPTER 30
TO THE CODE OF ORDINANCES OF THE VILLAGE OF CAPAC
BY REZONING CERTAIN PARCELS OF PROPERTY
WHEREAS The Village of Capac Planning Commission has recommended the following real property be rezoned from the Residential District (R1) zoning classification to the Commercial District zoning classification:
BEG AT E 1/4 COR, TH S 88D 12M 23S W 924.09′, TH N 02D 34M 04S W 330′, TH N 88D 12M 23S E 924.09′, TH S 02D 34M 04S E 330′ TO BEG SECTION 33 T7N R13E 7A

WHEREAS Section 30-184 of the Village of Capac Code of Ordinances requires the Village Council to consider any rezoning of property recommended by the Village of Capac Planning Commission and, if the Village Council decides to rezone property, the Village of Capac Code of Ordinances requires the Village Council to adopt an ordinance reflecting rezoning.
WHEREAS the Village Council believes it is in the best interest of the Village to rezone the aforementioned property from the Residential District (R1) classification to the Commercial District classification as those terms are defined in the Village of Capac Code of Ordinances.
NOW THEREFORE THE VILLAGE OF CAPAC ORDAINS:
SECTION 1. Rezoning of property
That the Village of Capac Zoning Map referred to in Section 30-227 of the Village of Capac Code of Ordinance is hereby amended such that the following property is rezoned from the Residential (R2) District classification to the Commercial District classification:

Parcel I.D. 74-27-033-2004-001
A revised Village of Capac Zoning Map reflecting the rezoning of the above properties shall be prepared and attached to Section 30 of the Village of Capac Code of Ordinances along with a copy of this Ordinance. Such revised Village of Capac Zoning Map shall replace the current Village of Capac Zoning Map.
SECTION 2. Severability
The provisions of this Ordinance are hereby declared to be severable. If any clause, sentence, paragraph, rule, regulation, section, or subsection is declared void or inoperable for any reason by any court, it shall not affect any other part or portion thereof other than the part declared void or inoperable.
SECTION 3. Effective Date
This Ordinance shall take effect 30 days after publication.
