VILLAGE OF ALMONT
An Ordinance to prohibit the loitering of minors.
THE VILLAGE OF ALMONT ORDAINS:
Section 1. Loitering Prohibited
It shall be unlawful for any minor under the age of 17 years to loiter, idle, wander, stroll, play in, or be found upon public streets, highways, roads, alleys, parks, public buildings, places of amusement and entertainment, vacant lots, or any public place between the hours of 8:30 p.m. and 6:00 a.m. of the following day, official Village time.
However, the provisions of this section do not apply to a minor under the age of 17 years accompanied by his or her parent, guardian, or other adult persons having the care and custody of such minor; nor where such minor is returning from any school dance or school entertainment; nor where the legal employment of such minor makes it necessary to be upon the streets, alleys or other public places during the night time after said specific hours.
Section 2. Responsibility
It shall be unlawful for the parent, guardian, or other adult person having the care and custody of a minor under the age of 17 years to permit such to loiter, idle, wander, stroll, play in, or be found upon the public streets, highways, roads, alleys, parks, playgrounds, or other public grounds, public places and public buildings, places of amusement and entertainment, vacant lots, or any public place between the hours of 8:30 p.m. and 6:00 a.m. official Village time, as set forth here after. However, the provisions of this section shall not apply to the exempted class mentioned in Section 1.
Section 3. Each Violation; Separate Offense
Each violation of the provisions of the above sections shall constitute a separate offense.
Section 4. Delinquent or Neglected Child
Any such minor violating the provisions of Section l shall be deemed a delinquent or neglected child as defined in the Statutes of the State of Michigan. Said minor shall be brought before the Juvenile Court having jurisdiction over said minor, and said minor shall be dealt with by said court as provided by law.
Section 5. Penalty; Parent
Any parent, guardian, or other adult person having the care and custody of a minor under the age of 17 years who violates Section 2, upon conviction hereof, shall be fined not less than ten ($10.00) dollars, or more than one hundred ($100.00) dollars, and in the default payment thereof, shall be confined in the County Jail for not more than thirty (30) days.
Section 6. Separability
It is the intention of the Village Council that each provision of this ordinance shall be deemed independent of all other provisions herein. It is further the intention of the Village Council that if any provision of this ordinance is declared invalid, all other provisions thereof shall remain valid and enforceable.
Section 7. Declaration
The Almont Village Council hereby declares an emergency due to the numerous youths congregating on the public streets in such manner as to jeopardize the peace and tranquility of the Village.
Section 8. Effective Date
This ordinance shall take effect at 8:30 p.m. on October 30, 2022 and shall remain in effect until 6:00 a.m. on November 1, 2022.
The undersigned President and Clerk of the Village of Almont hereby certify that this emergency ordinance was adopted at a meeting of the Almont Village Council on the 4th day of October 2022.
